In most cases, immigrants cannot be deported without first having a hearing before an Immigration Judge. If the Department of Homeland Security (DHS) believes that an immigrant should be deported from the United States, it will issue a notice telling the immigrant that he or she will need to appear in the Immigration Court. When the hearing is scheduled, an Immigration Judge will determine whether the immigrant should be deported or be allowed to stay in the United States. In this situation, it is vital to have an experienced immigration lawyer to present any possible defences against deportation. In some cases, the immigrant may be able to apply for a green card or political asylum directly with the Judge. In other cases, the attorney may argue that the immigrant is not deportable in the first place.
